Almost time for March Madness!

March Madness has many employees participating in the NCAA College basketball brackets, which typically includes monetary betting. Depending on the employers location and design of the activity, office pools are potentially unlawful. Restricting employees from  using company computers or other resources for the office pools, and blocking gambling internet sites from company computers are ways an employer can avoid running into problems.  Setting up an office pool with nonmonetary prizes and no entry fee could be a fun alternative to a monetary office pool.
 
Having a written policy on workplace gambling and using company resources can help prevent violations of the law.  We can help update your Employee Handbook or create a gambling policy.

Background Screen Challenges

​In addition to Non-Compete Agreements(discussed in January’s newsletter), another area of employment that is under careful review is Background screenings for applicants and employees.  Reasons include;

  • Growing momentum behind "clean slate" – Many states have passed a “fair chance” law through automatic expungement or sealing of criminal records after a certain time period. While the law is meant to help people with criminal records access better jobs, employers will be limited on the amount of information that can be considered for hiring.
  • Privacy laws that limit access to public records – Continued focus on candidate’s privacy and personal identifiers, such as date of birth, are becoming more limited. To have accurate screening, background screeners need to have access to this information to ensure the information is on the correct applicant.
  • Ongoing challenges of balancing drug testing with expanded marijuana legalization – As marijuana is legalized in states, employers must determine how to handle situations where candidates or employees may legally use marijuana.
As an employer, a couple of ways to avoid any issues associated with background screens include;
  • Using a reliable Background Screen company that is current with federal, state, and local laws. The Background Screen company can be a reliable resource for employers.
  • Ensure new hire procedures and employee handbooks accurately reflect employer policies, as well as recent laws.

Paid Leave Policy Survey

Do your Leave policies reflect current employee needs? Are your policies competitive?
 
A recent survey by NFP has provided a current snapshot of what leave plans employers are offering, such as;

  • 53% of employers offer a PTO Plan; 36% still offer a traditional vacation plan
  • 52% of employers provide 15 days or more in the first year of employment
  • PTO accrual typically starts on hire date
  • 61% of employers provide more than five paid sick days per year
  • 74% of employers still do not provide family caregiver leave
  • Almost 50% offer maternity leave as a stand-alone benefit separate from Short-Term Disability
  • Employers are increasing Bereavement leave and expanding the definition of bereavement leave
  • Since Juneteenth is now a Federal Holiday, 45% of employers include this day in their holiday schedule
 
Note: Many states have enacted state mandated Paid Sick or Paid Family Leave plans; however Texas does not have any state mandated plans for employee leaves.   The survey included various size employers with the majority in the 1-999 employee range.
