New Texas Legislation

While the Texas Legislature passed several bills effective September 1st, below are a few that employers need to know;

The “CROWN Act” prohibits discrimination based on hair texture or protective hairstyle associated with race.
Physical and electronic notices for employees regarding how to contact a workplace violence hotline must be posted. The TWC has until March 1, 2024 to develop a model poster.
Healthcare facilities must adopt workplace violence prevention plans by September 1, 2024.
Failure to require a vaccination against COVID-19 will not by itself make a business owner liable for an employee’s exposure to a pandemic disease by a coworker.

All Texas private employers are subject to the Texas Payday law. As a refresher, some key requirements of the law include;

Timely payment of wages due, at least twice a month for non-exempt employees and once a month for exempt employees
Deductions, other than payroll taxes, court-ordered garnishments, and other deductions required by law, made from an employee’s wages must be authorized in writing by the employee. Upon hire or before deductions are made, a Wage Deduction Agreement is recommended. Deductions should never take an employee’s wages below minimum wage.
Provides a deadline for final pay such as (a) employees that are laid off, discharged, fired or involuntarily separated must be paid within six (6) days. If the employee resigns, final pay is due on the next regularly scheduled payday following the resignation date.
