Hot Topic – on Dallas Paid Sick Leave

The Texas legislature ended without a decision regarding if cities can mandate Paid Sick leave for employees. Barring court intervention, the Dallas Paid Sick Leave ordinance will become effective August 1, 2019. Ordinance highlights include:
  • Requires employers with 15 or more employees to provide 1 hour of paid sick leave accrual for every 30 hours worked up to 64 hours. Employers with less than 15 employees must provide accrual for up to 48 hours of paid sick leave per year.
  • Accruals start on commencement of employment, but employer can preclude use until employee has worked at least 60 days if employer establishes that employment will be for one year or more.
  • Accrued but unused paid sick leave rolls over to the following calendar year unless the employer provides employees with 64 or more hours at the beginning of each calendar year.
  • There is no requirement accrued but unused sick pay be paid on termination of employment. However, if an employee is rehired in 6 months or less, the employer must grant the employee’s prior sick leave balance.
Note: Employers located outside the City of Dallas, but have employees performing services in the City of Dallas, are required to comply with the Dallas Paid Sick Leave.

Worker’s Compensation Non-Subscribers

Employers that Do Not have workers’ compensation insurance coverage are referred to as “non-subscribers”. Although a Texas employer may choose not to have coverage, noncovered employers must comply with certain workers ‘compensation guidelines such as:
  • An employer who does not have workers’ compensation insurance (non-subscriber) must file the DWC Form-005, unless the employer’s only employees are exempt from coverage under the Texas Workers’ Compensation Act (for example, certain domestic workers, certain farm and ranch workers). 
  • If an employer who terminates workers’ compensation insurance coverage, the DWC Form-005 must also be filed.
  • A notice must be posted at the workplace in a common area where all employees can view notifying employees that they do not have workers’ compensation insurance. If the notice cannot be posted, a copy should be given to each new hire.
  • Non-covered employers that have more than four (4) employees are required to report to the Division of Worker’s Compensation (DWC): 
  1. any work-related injuries that cause an employee to miss more than one (1) day of work, 
  2. all occupational illnesses, and 
  3. all fatalities that occur at the workplace.

2020 HSA Limits Rise Modestly, IRS says

​Health Savings Account (HSA) contribution limits for 2020 are going up $50 for individual coverage and $100 for family coverage, the IRS announced May 28th, giving employers that sponsor high-deductible health plans plenty of time to prepare for open enrollment season later this year. Next year, the annual limit on health savings account (HSA) contributions will be $3,550 for individual and $7,100 for family coverage.

More than one-third of American adults eat fast food on any given day, despite warnings about its impact on health and obesity, the U.S. Centers for Disease Control and Prevention (CDC) reported on Wednesday. The rate is especially high for young adults and gradually drops with age.
“Fast-food consumption has been associated with increased intake of calories, fat and sodium,” the CDC noted while reporting the prevalence of what medical experts have long considered an unhealthy eating habit, often associated with diabetes and heart disease.
But it’s cheap, quick, convenient and readily available, the report added, explaining fast food’s lasting popularity.
Before going to a fast food restaurant, look at their menu on-line for healthy choices. Several apps are available to help you find healthy food as well.
