Texas Payday Law Reminders

All Texas private employers are subject to the Texas Payday law. As a refresher, some key requirements of the law include;

• Timely payment of wages due, at least twice a month for non-exempt employees and once a month for exempt employees
• Deductions, other than payroll taxes, court-ordered garnishments, and other deductions required by law, made from an employee’s wages must be authorized in writing by the employee.  Upon hire or before deductions are made, a Wage Deduction Agreement is recommended. Deductions should never take an employee’s wages below minimum wage.
• Provides a deadline for final pay such as (a) employees that are laid off, discharged, fired or involuntarily separated must be paid within six (6) days. If the employee resigns, final pay is due on the next regularly scheduled payday following the resignation date.
